Urgent! Save the Law for Closing Criminal Cases against Orange Demonstrators!!

 דחוף!! הצילו את "החוק לביטול התיקים הפליליים נגד המפגינים הכתומים"!!

על פי נתונים רשמיים של הפרקליטות והמשטרה שפורסמו בכנסת לפני כשבועיים, למעלה מ-1500 מפגינים כתומים — אזרחים למופת  לרבות לוחמים רבים ביחידות קרביות –  עדיין עומדים לדין, או מוכתמים ברישומים "פליליים" במשטרה, בגלל הפגנות שונות בתקופת ההתנתקות.   החוק לביטול התיקים הפליליים הללו זוכה לתמיכה של חברי כנסת רבים – גם משמאל.

אבל אולמרט בכל זאת הצליח לשכנע את חברי הקואליציה לעשות "תרגיל":

היום פתאום אנחנו שומעים, שחברי הכנסת מהקואליציה התומכים בחוק "לא יוכלו" להצביע בעדו אם החוק לא יעבור קודם "ועדת שרים לענייני חקיקה" שמתכנסת רק בשבוע הבא.

המשמעות: בשבוע הבא הרי אין הצבעות (זה שבוע אחרון לפני פגרת הכנסת) אז נצטרך לחכות עם החוק עד לאחר פגרת הכנסת (כלומר: עד אחרי החגים.)

את התרגיל הזה עלינו למנוע. מדוע?

א. אין שום הצדקה לעוד כמה חודשים של התעללות משפטית בלתי מוצדקת!!!

ב. בפוליטיקה מה שלא מתבצע היום — לא מתבצע אף פעם. (ולכן אולמרט עושה את התרגיל…)

איך לפעול?

להפציר בחברי הכנסת הימניים מהקואליציה, בנימוס רב, לנהוג בגבורה, לא לשתף פעולה עם התרגיל של אולמרט:

שידרשו   שהקואליציה לא תתנגד לחוק, – זה ייתן למעשה  חופש הצבעה. ושיגיעו – ויצביעו

מתי? מייד!!  היום (יום שני), הערב, הלילה ולכל המאוחר מחר (יום שלישי) בבוקר

URGENT KNESSET UPDT

Tomorrow and the next day (Tuesday and Wednesday) there will be the vote on the law which will close the ridiculous criminal cases against 1500 Orange demonstrators.

"Halevai" that the actions of the Orange demonstrators, in perhaps blocking traffic for a few moments or in possibly spontaneously pushing a policeman to prevent him from improperly beating up someone, and so forth, should be the Israel's justice system's main problem (what happened to rape, drugs, traffic accidents, terror attacks, family violence, and organized crime??).

Good news: The law is widely supported by many Knesset members on left and on right. The main problem is, though, that Olmert is pressuring some of the law's supporters, so we need to call these MKs RIGHT NOW — or this evening, or latest tomorrow morning (Tuesday morning) in order to very politely ask them to please vote FOR the law tomorrow and the next day. Please specifically say that you heard that Olmert is doing a "targil parliamentari" aimed to push off the vote until after the chagim (by that time, Olmert will think of another excuse to put it off even more…) and ask each MK not to let Olmert do that. Do not let the MKs persuade you that actually the above is not the factual situation. Keep insisting, pleasantly of course, that you are absolutely sure that the right thing to do is to vote for this law tomorrow (in the Vaadat haKnesset) and the next day (in the Knesset melia=plenary).

On Sunday morning the government intends to decide to give 700 million dollars to Abu Mazen’s Fatah which controls the Palestinian Authority. Aren’t the Fatah oriented toward peace? No they most certainly are not. For example, in 2005, the Fatah sent  47 suicide bombers into Israel (fortunately all of them failed) which is an even higher number than the Hamas which sent “only” 29 suicide bombers in the same year.

Stop the madness, send a quick SMS to the very powerful Knesset Finance Committee chairman MK Stas Miszenikov., a member of   Avigdor Liberman’s party., and demand that he block the government’s  financial empowerment of terrorism. הנידון: מחיקת כתבי האישום הפוליטיים נגד הכתומים

הזמנה לכנס שיתקיים בכנסת ביום שני

במאבק הציבורי נגד ההתנתקות היו מעורבים עשרות אלפי אזרחים. מערכת אכיפת החוק הפעילה נגדם כללים מחמירים במיוחד לאורך כל הדרך: בשטח, בחדרי החקירות, בתאי המעצר, במשרדי התביעה ובבתי המשפט. למשל — נקבע שבניגוד למקובל בארץ ובכל העולם — אסור להתחשב בעובדה של"נאשם" כתום אין עבר פלילי. 

נכון להיום, למעלה מאלף איש כולל בני נוער עדיין סובלים מ"רישומים משטרתיים שמהווים מכשול בצבא ובאזרחות. עד היום עדיין נכתבים ומוגשים כתבי אישום נוספים נגד מפגינים, על עבירות-של-מה-בכך.

לא נוכל להמשיך ולהחשות. הגיע העת לבטל את כל כתבי האישום ואת כל הרישומים המשטרתיים מתקופת ההתנתקות. מנחם בגין אכן ביטל את כל ההליכים הפליליים כנגד מתנגדי הנסיגה מסיני כדי לאחות קרעים וכך היה צריך לנהוג כבר מזמן, מייד אחרי גירוש גוש קטיף.

לא נוכל למחוק  את הפגיעות בגופם, בנפשם, בחירותם, בשמם הטוב ובחופש הביטוי של כל אותם מפגינים – אך לפחות את  העתיד נוכל לשפר ולתקן.

ביום שני  הקרוב 18 ביוני, בשעה 17:00, באולם ההרצאות בכנסת – חברי כנסת מ-6 סיעות שונות (קדימה + ש"ס + ליכוד + ישראל ביתנו + איחוד לאומי-מפד"ל + גימלאים)  יתכנסו ויגבשו דרכי הפעולה לביטולם של כתבי האישום של ההתנתקות.

One tiny email from you can be very helpful to the Orange protestors' self-respect!  Your email will be to the 49 "best" Knesset members so they will feel that the entire public is inviting them to a Monday meeting in which the plight of the Orange protestors will be discussed. The Orange protestors have already been showered with over 1000 criminal indictments since the disengagement period, and even more are in the pipeline.

These protestors are Israel's best. Their most common complaint about their criminal indictments – for such "crimes" as non-violently blocking an intersection for a few moments –  is the following: "Oh, my!! My criminal indictment might prevent me from serving in the most difficult army units!!"  Yes — this is the kind of "criminals" on whom Israel's highly politicized legal system is wasting its time – and our tax money. These are not criminals at all — they are simply dissidents who love their country, who protested in order to fix things not break things, and who to this very day are standing in line to serve, perhaps G-d forbid give their lives,  in the IDF's best and most dangerous units.

Don't stand for the way the legal system treats these people who offenses were political — NOT criminal. Invite the MK's TODAY to the Knesset task force, which will be meeting this Monday at 5 PM to say STOP THE POLITICO-LEGAL PROSECUTION OF ORANGE DISSIDENTS IN ISRAEL.  Just forward this entire email (you can erase irrelevant parts and/or add a personal message from you if you wish) to all of the following – thank you so much from Mattot Arim:

צעדה בנגוהות: יום אחרי חג השבועות

מתי? ביום חמישי 24.5  ז' סיון בשעה 16:00 (עד שעה 19:00 לערך)

מדוע? כדי להשיק נושא חדש: הצורך לפתוח את כביש נגוהות לתנועת רכבים באופן חופשי, כדי למנוע חניקת היישוב הקטן נגוהות שכרגע אין לו כביש גישה לשאר היישובים .  גישה שמותרת רק כשיש ליווי צבאי – אינה באמת גישה.

מה בתכנית ? ניסע ברכבים על הכביש המדובר, מאדוריים לנגוהות. אם צה"ל לא יאפשר זאת – נלך ברגל. בעבר, בארועים דומים, המשטרה לעיתים עיכבה צועדים בודדים לזמן קצר (מספר שעות) ו/או נתנה להם זימון לחקירה.

כיצד להגיע לאדוריים?

 * מכיוון ירושלים : נסיעה על כביש 60 דרומה, עד לבית חגי. כ-2-3 ק"מ אח"כ ישנו  מחסום צה"לי. להמשיך ישר ומייד אח"כ פניה ימינה (מערבה) לבסיס צבאי אדוריים .

 * מכיוון באר שבע: נוסעים על כביש 60 עד לעתניאל ומשם עוד כ-5 ק"מ פניה שמאלה (מערבה) לכוון בסיס אדוריים.

 * תחבורה ציבורית: קו 440 מתחנה מרכזית בירושלים בשעה 14:50, עובר דרך ק. ארבע בערך ב-15:40

רקע : נגוהות הוא יישוב קטן במקום חשוב, באזור הר חברון. לפני שבע שנים, עברו אזורים נרחבים בהר חברון, שלא היו מיושבים על ידי יהודים, לשליטת המשטרה הפלשתינאית (שטח A). בנוסף – אולי במאמץ ליצור תקדים – הועבר גם קטע מכביש הגישה אל היישוב נגוהות. מאז הכל קרס , וחברי ה"משטרה" הפלשתינאית (שהיתה אמורה "להגן" על כביש אדוריים-נגוהות) נתגלו כמי שהשתתפו בעצמם בכמה וכמה פיגועים.

בכל זאת,  נהלי הנסיעה בכביש מחייבים ליווי מפני שצה"ל לא מוכן להגן על הכביש באופן "מרחבי" (כלומר צה"ל לא מוכן להפוך את הכביש למקום בטוח ע"י ביצוע פעולות מודיעיניות, מעצרים של מחבלים, תפיסת נקודות שמהם ניתן לצלוף על הכביש, ועוד. (  ומה הלאה? אם מספיק אנשים יבואו, נוכל להראות שזהו נושא ציבורי – ואז, הנושא יטופל (כך עולה מנסיון העבר).

משפט נוסף : אלימות משטרתית נגד ה"כתומים" (ואחרים…):

את.ה זוכר.ת את ההתקפה המשטרתית המאד מזעזעת נגד המפגין עקיבא ויתקין? אז אנא – בוא.י למשפט נגד אותם שוטרים אלימים שתקפו את ידידנו עקיבא כדי להראות שיש עניין ציבורי במשפט החשוב נגד אותם בריונים, על פי החשד (שתועד בוידאו אגב). תל-אביב, יום א, 27 מאי (י' סיון), בבית המשפט השלום בשעה 11:30 באולמו של השופט חנן אפרתי. פעמים רבות משפטים נדחים ברגע האחרון (אתה יודע למה) ולכן יש להתקשר לנוגה ממטה ת"א ערב לפני כן — עד שעה 23:00 — כדי לוודא שאין שינוי 050-4088754.

DAY AFTER SHAVUOT – WALK TO HELP NEGOHOT

Negohot is a small yishuv that needs your help. On Thursday 24.5 (the day after Shavuot) from 4 PM – 7 PM they are having a march along their road, which connects them to the next yishuv and from there to "their" local city — Kiryat Arba, where they work, study (children) and get medical care.

Unfortunately, their road has been closed off because it used to be considered Palestinian territory — since the infamous Oslo Accords defined it as Area A (whoops — the politicians didn't notice there was actually a yishuv there until it was too late). The people of Negohot can only use their road if escorted by a (rare) military escort, so essentially they are under siege. They do have a back road but this takes them to precisely the wrong direction — to faraway Kiryat Gat, which is not where any of them either work or study!!

If the people of Negohot get a good turnout on their walk, they will be able to raise their road (their lives) as a public issue (just like Brown vs. The Board of Education in the USA) and their problem will get solved. So, if you can — please join them.  The plan, ostensibly, is to drive to Negohot from the next yishuv on the way to Kiryat Arba (called Adorayim), however, since this almost certainly will not be permitted — please be ready to make the walk which is the next alternative. In the past, the police have occasionally detained a few people for a few hours under similar circumstances, or have "summoned them for questioning" later.

Directions : The walk starts at Adorayim. From Jerusalem, take a 440 bus from the Central Bus Station at 14:50. This goes thru Kiryat Arba at about 15:40. Driving from Jerusalem: Take Kvish 60 south to Bet Hagai. 2 – 3 km later turn west to the Adorayim army base (continue straight after the army "machsom"). Driving from Beer-Sheva, use Kvish 60 to get to Otniel.   " Well known families " are hassling Israeli army officers

On 15 May the Maariv newspaper ran a piece about "radical pro-Palestinian groups" at Harvard University; these are trying to hassle the IDF's former chief of staff because of the IDF's purported "war crimes" against the Palestinians, poor things. Reporter Ben Caspit wrote that some of these Harvard lunatics are "sons of well known families in Israel" — but chose  not to inform his readers which families he is referring to. If you are anxious to find out and think you deserve to know — by all means, email Ben Caspit kaspit@maariv.co.il, in Hebrew, and urge him to please publish the names of the families in question. For example – the Olmert family would not happen to be one of the families, would it? Kindly send a bcc copy of your letter to mattot.arim@gmail.com, with "Ben Caspit" in the subject line. You may have seen in the paper that Yom Haatzmaut (Tuesday 24 April 6 Iyar)  is the next visit to Chomesh — this time for only one day. Bring  walking/climbing shoes and warm clothes, food and water. Busses cost 20 NIS and are round-trip: there and back, same day, don't bring your sleeping bag this time. Sign up now (you MUST do so till midnight of the night before (till Monday midnight).

It seems that the PMO's office has been passing them out. If Olmert's picture is there, ask the school or kindergarten in a friendly way to remove it, and if they are not happy about that idea, simply do so yourself.
